Abstract
Terör ve terörizm kavramları arasındaki farkın belirlenmesi sorununun yanında terörden
ne anlaşılması gerektiği, hangi eylemlerin terör kapsamına girdiğini belirlemek oldukça
güçtür. Klasik bir deyimle birilerinin terörist olarak değerlendirdiği kişiyi, başkaları sözde
özgürlük savaşçısı olarak değerlendirebilmektedir. Terörle hukuki çerçevede etkin mücadele
için ise öncelikle terörün tanımlanması gerekmektedir. Bu etkin mücadeleyi gerçekleştirirken
de devletlerin, insan hakları yükümlülüklerini üstelenmeyi devam ettirmesi zorunludur.
Bu çalışmada, literatürdeki farklı terör tanımlarına değinilecek aynı zamanda terörle
terörizm arasındaki fark ortaya konmaya çalışılacaktır. Ardından terörle mücadele ile insan
hakları meselelerinin kesiştiği alanlar sadece isim olarak ortaya konduktan sonra terörle
mücadelenin yaşam hakkıyla bağlantısı ayrıntılı olarak incelenecektir. Yine bu kısımda
Avrupa İnsan Hakları Mahkemesi ve Türk Anayasa Mahkemesinin ilkesel nitelikteki kararları
irdelenecektir.

Aside from the challenge of distinguishing between the notions of terror and terrorism,
it is also difficult to identify what should be fully grasped from the act of terror and which
activities are encompassed within the scope of terror acts. To put it in a cliché phrase, the one
who is deemed a terrorist may be regarded as a freedom fighter by others. In order to be able
to combat terrorism effectively within the legal framework, it is therefore vital to define
terrorism at the outset. While carrying out this effective uphill struggle, states should remain
to assume their human rights obligations.
In this research, various definitions of terrorism from the literature will be analysed, as
well as the distinction between terror and terrorism. Following the identification of instances
where the fight against terrorism and human rights issues are overlapping, the nexus between
the fight against terrorism and the right to life will be examined in depth. Furthermore, the
relevant landmark judgments of the European Court of Human Rights and the Turkish
Constitutional Court will be reviewed in this part.
